Terms of Service - Sesame. Pictures

1. Agreement

These Terms of Service ("Terms") govern your use of the Sesame. Pictures website at sesamepictures.com and any photography services you book through it ("Services"). By placing an order, you agree to these Terms. If you do not agree, please do not book a session.

2. Bookings and Payment

Mini Session and other photography bookings are reserved when payment is received in full. We accept payment through Shopify's secure checkout. All prices are in US dollars and include applicable taxes where required.

3. Refunds, Reschedules, and Cancellations

All refund and reschedule terms are set out in our Refund Policy, which is incorporated into these Terms by reference.

4. Image Use and Licensing

Upon final delivery of edited images, you receive a personal, non-commercial license to use the images for your own enjoyment, including printing, sharing on personal social media, and displaying in your home.

Sesame. Pictures retains the copyright in all images. You agree not to sell, license, or use the images for commercial purposes (including paid advertising, magazines, or stock libraries) without our written permission.

Sesame. Pictures may use the images in its portfolio, on its website, on social media (including Instagram and Facebook), in printed marketing materials, in submissions to photography publications, and in advertising for Sesame. Pictures. If you would prefer your images not be used publicly, please email info@sesamepictures.com before your session.

5. Photos of Children

If your session includes children, by booking you confirm that you are the parent or legal guardian of the children being photographed and consent to their being photographed and to the use of the images as described in section 4. If both parents share legal custody, you confirm that you have authority to make this decision on behalf of the other parent.

6. On the Day of Your Session

Mini Sessions are scheduled in tight back-to-back blocks. Arriving on time is essential. Sessions cannot run over and late arrivals will shorten your shoot time, not delay the next family's start. We recommend arriving 5 to 10 minutes early.

7. Weather and Safety

For outdoor sessions, Sesame. Pictures reserves the right to reschedule due to unsafe weather (heavy rain, dangerous heat, smoke, etc.). You will be notified by email or text by 9 AM the day of the session at the latest, and offered a reschedule at no additional cost.

8. Delivery

Edited Mini Session images are typically delivered within two to three weeks via a private online gallery. Delivery timelines are estimates, not guarantees. You will receive a link by email when your gallery is ready.

9. Limitation of Liability

To the maximum extent permitted by law, Sesame. Pictures' total liability for any claim arising out of or in connection with the Services is limited to the amount you paid for the session. We are not liable for indirect, incidental, or consequential damages. In the unlikely event of equipment failure, file corruption, or other circumstance that prevents image delivery, our sole obligation is to refund the amount paid for that session.

We may update these Terms from time to time. Bookings are governed by the version of the Terms in effect at the time of booking.

12. Governing Law

These Terms are governed by the laws of the State of California. Any dispute will be resolved in the state or federal courts located in Orange County, California.
